Hi!

Bavi li se još netko time kod nas? Ima nova presuda EU koja kaže da se
ta naknada može naplatiti samo krajnjem korisniku koji će presnimavati
nelicencirani materijal. Po meni to je skoro nemoguće provesti :), a
zato su se i uvodili ovakvi sistemi koji otkidaju na svakom prodanom
mediju, a što uistinu nije uredu.

Court rules against Spain in digital copyright case

ECJ says firms that sell writeable discs should not be liable for
copyright payments.

The EU's Court of Justice has ruled that companies that sell digital
recording material such as writeable CD and DVDs should not have to
pay levies for private copying.

The court today (21 October) ruled that Spanish law, under which such
firms were liable to pay levies to rights-holders for reproduction of
their work, was incompatible with EU copyright legislation.

The court was ruling on a case involving the Spanish collecting
society SGAE, which had asked Padawan, a company that sells writeable
CDs, DVDs and MP3 devices, to pay a levy for private copying.

The court found that the EU copyright directive allows member states
to impose a private copying levy to compensate artists, writers and
other rights-holders for reproduction of their work. But it found that
the copying levy can only be imposed on consumers who will be making
copies for private use and not on companies that market writeable
discs and devices.

The ruling has been welcomed by Digital Europe, a group representing
the electronics industry. Bridget Cosgrave, Digital Europe's
director-general, said in a statement that the court's judgement was a
"welcome signal" that European lawmakers recognised the importance of
adapting the copyright levies system to one "more in line with today's
digital reality".
